Terms of Use

These Terms of Use ("Terms") govern your use of the SoundSleep iPhone app, published by GoSwift Media ("we", "us"). Please read them carefully. If you do not agree, do not use the app.

1. Acceptance

By downloading, installing, or using SoundSleep, you agree to these Terms and to our Privacy Policy. If you use the app through Apple's App Store, you also agree to Apple's Licensed Application End User License Agreement (EULA), which is incorporated by reference. Where these Terms and Apple's standard EULA conflict, Apple's standard EULA governs to the extent required.

2. License

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use SoundSleep on Apple-branded devices you own or control, for your own personal, non-commercial use, in accordance with these Terms and the App Store Terms of Service.

3. Health disclaimer — important

SoundSleep is a wellness and informational tool, not a medical device. It does not diagnose, treat, cure, or prevent any disease or condition, including snoring disorders or sleep apnea. Sound detection and classification are produced by automated, on-device machine-learning models and may be inaccurate or incomplete. Do not rely on SoundSleep for medical decisions. Always seek the advice of a qualified health professional with any questions about your sleep or health, and never disregard professional advice because of something you saw in the app.

4. Subscriptions & billing

SoundSleep offers optional "Pro" features through auto-renewable subscriptions and a one-time purchase, sold via Apple In-App Purchase:

• Monthly — US$5.99 per month.
• Yearly — US$29.99 per year, including a 7-day free trial for new subscribers.
• Lifetime — US$59.99 one-time (see below).

Prices are in U.S. dollars and may vary by region and over time; the price shown in the app at the time of purchase applies. The free portion of any free trial is forfeited when you purchase a subscription.

Auto-renewal

Auto-renewable subscriptions automatically renew for the same period at the then-current price unless cancelled. Payment is charged to your Apple ID account at confirmation of purchase. Your subscription renews automatically unless you turn off auto-renew at least 24 hours before the end of the current period, and your account is charged for renewal within 24 hours prior to the end of the current period.

Managing & cancelling

You can manage or cancel your subscription, and turn off auto-renewal, in your App Store account settings (Settings → [your name] → Subscriptions) after purchase. Cancellation takes effect at the end of the current billing period. Apple manages all billing; we cannot issue charges or refunds directly — refund requests are handled by Apple under its policies.

5. Lifetime purchase

The Lifetime option is a one-time, non-consumable purchase that unlocks Pro features for the lifetime of the app on your Apple account. It is not a subscription and does not renew. "Lifetime" refers to the supported lifetime of the SoundSleep app and does not guarantee perpetual availability of any third-party service the app may rely on.

6. Acceptable use

You agree to use SoundSleep lawfully and to record only with the awareness and, where required, the consent of anyone whose sounds may be captured. You agree not to reverse engineer, resell, or misuse the app, or use it in any way that violates applicable law or the rights of others.

7. Intellectual property

SoundSleep, its design, branding, and software are owned by GoSwift Media and protected by intellectual-property laws. These Terms grant you a license to use the app, not any ownership rights. Content you create (such as your recordings and notes) remains yours and stays on your device.

8. Disclaimer of warranties

The app is provided "as is" and "as available," without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that detections will be accurate.

9. Limitation of liability

To the maximum extent permitted by law, GoSwift Media will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from your use of the app. Our total liability for any claim relating to the app will not exceed the amount you paid for it in the 12 months before the claim.

10. Termination

These Terms apply until terminated. Your license ends automatically if you fail to comply with them. You may end them at any time by deleting the app. Sections that by their nature should survive (including disclaimers, limitations of liability, and intellectual-property terms) survive termination.

11. Governing law

These Terms are governed by the laws of the Commonwealth of Puerto Rico and the United States, without regard to conflict-of-laws rules. Nothing in these Terms limits any rights you may have under the mandatory consumer-protection laws of your place of residence.
